Lenovo Online Data Backup License and Service – Privacy Policy

 

This Privacy Policy supplements the general Lenovo Privacy Policy by adding terms or making clarifications specific to the Lenovo Online Data Backup Service (“the Service.”)  For more information, please refer to the general Lenovo Privacy Policy, which is incorporated herein by reference.  By registering to use the Service, you agree to the terms of this Privacy Policy.

DEFINITIONS

“Personal Data” is defined as any data from which it is practical to determine the identity of an individual, such as name, address, email address, telephone number, credit card number, or Service account number.   You will provide Personal Data to Lenovo when you register for the Service or communicate with us.

“User Data” is defined as any data you back up with the Service.  User Data may include Personal Data about you or others. 

DATA COLLECTION

1.      Lenovo collects Personal Data about you to register you for the Service and manage our business relationship with you, including credit card information needed to process your purchase.

 

2.      When you back up your User Data using the Service, you submit your User Data to Lenovo.  You also submit your IP address and file system information, including names of files and directories.

 

3.      Lenovo collects certain passive web usage data, including your IP address, cookie information, web beacons, URL information, and the web pages requested.  Lenovo may also use commonly used online information-gathering tools like web logs and web beacons.

DATA USES

1.      Lenovo uses Personal Data about you to register you for the Service, process your transaction, provide the Service to you, communicate with you about administrative issues with the Service, provide customer service, or otherwise manage our business relationship with you.  Aggregated, non-identifying information may be used for internal purposes to provide support or improve the Service.  Lenovo may also use your Personal Data to communicate with you for marketing purposes – that is, to provide you information about products and services you may find of interest.  Before Lenovo communicates with you for marketing purposes, we will give you an opportunity to choose whether or not to have your Personal Data used in this way.  Lenovo will not share your Personal Data with third parties for them to use for marketing.

 

2.      When you submit your User Data using the Service, Lenovo may view your file system information (file extensions, sizes, etc.) to provide technical support, but Lenovo will not access, use, sell, or disclose your User Data except as disclosed in this Privacy Policy.   Lenovo will not share your User Data with third parties for them to use for marketing.

 

3.      Lenovo uses passive web usage data to provide the Service to you and to improve the Service.  Lenovo uses cookies on users’ browsers and hard drives to save user screen names and session validators and may use them to provide tailored products and services to users.  You may disable cookies if you wish, although doing so may limit the website’s functionality.  Web beacons may be used on Lenovo web pages or in e-mails to you to better understand and improve the usability, performance, and effectiveness of the website and the Service. 

 

 

DISCLOSURES OF DATA

1.      Lenovo may disclose Personal Data, User Data, or web usage data where required by law, subpoena, administrative order, or court order, or where we deem it necessary to protect the rights of Lenovo or the safety of individual. 

 

2.      Lenovo may use outside entities to provide and assist in administration of the Service, including processing credit cards or backing up User Data.  These outside entities will be contractually required to abide by the same restrictions explained herein and will be prohibited from using Personal Data or User Data for any other purpose.

 

3.      If Lenovo were to transfer its Online Data Backup Service operations pursuant to a merger, sale, or bankruptcy, Lenovo will make commercially reasonable efforts to ensure that Your Personal Data and User Data remain subject to essentially the same restrictions explained herein.

 

PASSWORDS AND ACCESS TO YOUR USER DATA

Your User Data is stored in encrypted form. You will be given a choice of setting your own encryption key or having Lenovo provide you with one that is securely kept in an escrow by our Service Provider. 

         If you have Lenovo manage your encryption key through a secured escrow service, Lenovo will have a procedure available to access your User Data again if there is need for back up. 

         If you set your own encryption key and you forget it, we will not be able to decrypt it and you will lose access to your User Data.  In order to backup your current data, you will have to re-start the upload process from the beginning and choose another encryption key or use one provided by us.  If you choose not to re-start the upload process, your inaccessible data will be securely destroyed 30 days after termination of your Service.

USER DATA DESTRUCTION

 

Prior to the end of a trial period or the end of the period of Service you purchased, Lenovo will send you multiple email reminders for renewal.  If you choose not to register or renew, Lenovo will use commercially reasonable efforts to make your User Data available for you to download for a period of 30 days.  After that period, your User Data will be securely destroyed. 

 

Following termination of your account, your Personal Data will be stored for a commercially reasonable period of time and then securely destroyed. 

 

TRANSFERS OF YOUR DATA

Lenovo may, as permitted by applicable law, transfer your Personal Data or User Data to any country worldwide in which we or our service providers assisting with the Service do business.  Some countries may provide less legal protection for information than others, but Lenovo will still handle information as we describe here. 

 

DATA SECURITY

We intend to protect your information and to maintain its quality and integrity.  We implement appropriate measures and processes, such as using encryption when transmitting certain sensitive information, to help us keep your information secure and to maintain its quality.  Although we take reasonable steps to ensure the integrity and security of our network, systems, and data, it is not possible to guarantee that our security measures will always prevent Personal Data or User Data from being subject to unauthorized access or acquisition. 

Your User Data will be transmitted and stored in encrypted form.

Lenovo strongly urges users of the Service to carefully protect the security of their password.

 

UPDATES TO THIS PRIVACY POLICY

This Privacy Policy was last updated on July 1, 2008.  A notice will be posted on the Service website for 30 days if this Privacy Policy is changed in a material way.
